R50/53 Club liability insurance--what should I get?

The club's liability insurance is expiring next year and we're looking for a new company.

    when we looked into it for mini5280 the cost was totally prohibitive. We would have needed on the order of 60 memberships each year just to pay the insurance premium. That was through the insurance company that BMWCCA uses.

    The Portland OR club looked into it, but also found it far too expensive and now just have people sign liability waivors before driving events.

    Have members sign a waiver. That's also how SCMM does it.

    Hi all! Thanks for the great feedback.

    So who has a bullet-proof waiver form? Do you have a form number or place to purchase these?

    The one I used at my last event is very similar to one's I've seen other events and a lawyer told me that thing was full of holes. Sure enough I read thru it and understood it. You know things are bad when an average person can actually read/understand the wording of a legal document.

    The following waiver is similar to the one mini5280 is using. Please consult legal representation familiar with your state's laws before using any liability waiver.


    CLUB NAME
    Liability Waiver & Release Agreement

    By participating in the CLUB NAME EVENT NAME, on DATE, I represent that I am at least 18 years of age and have a valid driver's license. I further represent that I have all necessary licenses and insurance to participate, and that I am not taking any drugs or medication, nor do I have any physical or mental limitations, which would interfere with my safe participation. I recognize that the operation of any MINI is an inherently dangerous activity with a risk of loss of the MINI and serious injury or death to my passengers and myself. I understand that these risks include, but are not limited to, road surface conditions, debris on roads, varying road widths, curves, and other vehicles and pedestrians sharing the roadway, and the skills of other participants.

    In consideration for being permitted to participate in the CLUB NAME EVENT NAME, I the undersigned on behalf of myself and my heirs, executors, administrators, assigns and legal representatives, agree and indemnify, defend and hold harmless CLUB NAME and their representatives, individually and in the capacity indicated, from and against any and all damages, claims, suits, causes of action to and against a person and property, (including but not limited to attorney's fees) arising in connection with or related to my participation.

    Further, I assume all risk of injury and loss, waive and release any claim of damage and injury of any nature I might state against CLUB NAME and their representatives, who assist in the capacity indicated, arising out of my participation.

    I have been offered the opportunity to consult with the legal and/or other advisors of my choice before signing this Unconditional Waiver and Release, and I enter into freely and on behalf of myself and my heirs, successors, and assignees.

    This Unconditional Waiver and Release shall be constructed under the laws of the State of ________, and the exclusive venue for the resolution of all disputes pertaining to CLUB NAMEshall be in the appropriate municipal, state, or federal court, located closest to CITY, STATE. Should the Release Parties need to retain counsel to enforce the provisions hereof, the prevailing party in any such action shall be entitled, in addition to any other relief, to recover his, her, or it’s attorney's and expert's fees.

    DiD, did the policy Mini5280 looked at, include racing/competitive events? If so, that will make the cost skyrocket.

    All, So what type of annual charges are people seeing for club insurance without competitive types of events?

    Racing and Competitive events were not included in our quote (as I said above the policy was very basic and it still was $1500, which we deemed prohibitive). Competitive events would have been handled on a case by case basis with a rider to our policy.

    THAT SAID, for competitive events, our local track (2nd creek raceway) would let us buy a rider from them. We didn't persue that much either, because BMWCCA in Denver has welcomed the MINIs with open arms to their autocross events and drivers schools.

    Was 1500 regardless of number of members or is the fee calculated by number of members?

    Do you have a contact at the insurance you're referring to here?

    It was a long time ago, but I seem to recall that the club size didn't really play into it very much, at least within the confines of a club in the 60-120 member range.

    K&K Insurance Motorsports Division

    K&K is pretty much the industry leader for track event and enthusiast club insurance
