Assuming you are refering to the JCW intake system not opening the "flap" to allow additonal air flow from the cowl area until 4500 rpm:

JCW stated in an email to me that additional air flow is not required until 4500 rpm, although I've read that this may have something to do with ensuring the intake meets worldwide noise regualtions:

Removing the partition between the engine bay and cowl area as required for installing the Alta intake or cutting holes in the partition is going to make for more noise, but I don't think anyone has substantiated how much additional power is gained by allowing more air flow from the cowl area.

JCW's explanation makes sense. Why would the engine need more airflow at lower RPMs? Reducing any restriction to airflow will always help, but an engine is just an airpump.

Yesterday I heard at my dealer (Crown MINI of Richmond) the 05 kits and I assume the upgrade kits too would be available around October 18 or so...at least the initial batch.
