speed limit in residential area?
speed limit in residential area?
any one know how to find this out... did searches couldn't find it... just emailed the DOT which might take forever to hear back from haha.. reason is i got a ticket this morning at 5:30AM!! going to work which is 7 minutes driving time... probably close to two miles... but anyway made a turn in my apartment complex area which leads to a hill. i have the car in 2nd gear and accelerate a little so im not moving at snail speed coming off the turn i just made... now this is a long semi steep hill so i dont need to accelerate down the hill especially because one i have only been up for 30 minutes and im just relaxed and two it's not necessary. i have the car in second gear for a few seconds then depress the clutch and brake down the hill... i was going 30, 31 tops... meanwhile i have been watching this cop for about halfway down this hill sitting at the bottom of the hill perpendicular to me... i approach the stop sign to cross the street. i continue through the intersection and of course he turns his lights on and pulls me over.... im thinking what could i possibly have done i know i stopped. i didn't even think it could be speeding.. i was thinking maybe tint? i dont know... but anyways he come and take my license and asks the usual " do you know why im stooping you" and of course i say no because i really have NO idea why. he claims i was doing 39 in a 25? i think this is bogus... how far away can they radar people.. i dont think he could of had an angle to me one and two i would of had to be accelerating to get to 39... and my car would of read 41/42 because it reads 2/3 mph faster... ugh! so i scoped it out and there is no signs posted speed... i thought in Texas it was 30 for residential, but im not sure about Washington? sorry for being so long im so frustrated... this is my first ticket and its at 5:30 AM!!!
Here is a link for National Motorists Association website,

They are the drivers advocacy organization responsible for the repeal of the 55mph national speed limit. They have a lot of resources and advice on how to fight a ticket.

You are correct about the lowest enforceable limit in TX being 30mph, with school zones being an exception. This is not to say that they won't try and give you a ticket for it regardless (there are residential areas that post a 20mph limit), merely that if you fight it, you have a pretty clear case that you can win.
im from texas... texas license and registration and insurance... but i just moved to WA about 7 or 8 months ago...

I got a ticket in Snohomish County - 52 in a 35 zone - I was coming DOWN a hill, in neutral, a week after I got my car, on the way to a job interview - the Sheriff told me to challenge the ticket, so I did. Ticket got overturned on some technicality. I'm a lawyer but I didn't represent myself - got another lawyer to do it. Ticket would have been 190 - paid the lawyer 300 . . no points on my license and no increased insurance. If you want the lawyers details just PM me.
FWIW in FL if you move you have 10 days to get a new license. Residential unless otherwise posted is 30 mph.
well i am here for grad school. so i dont think that would apply to me... maybe when im done with school it would... im most familiar that residential is 30 unless posted otherwise too... so i guess we will see... but my biggest anger is that it was 5:30 in the morning! I wasnt trying to speed down a hill. and i know i wasnt speeding... unless it is 25 then i was going 5 over...
The information you're looking for should be in your driver's handbook, the one you're supposed to be using to get ready to take the test within 30 days of moving to a new state, right?
What difference does 5:30 am make? Either you were speeding or not. I think I'd go back to the street in question and see if you can find a speed limit sign, then you'll know. If it's 25 mph, you may be toast, see if you can take a driver's class instead? A lot of states do this iif it's your first offense in state.
If you go to court, they may hassle you about not getting a local license by now, unless you're maintaining your Texas residence and are just there temporarily.

my frustration of being 5:30 is because im not speeding around when its pitch black out just frustrating that i know i wasnt doing anything wrong unless its 25 then i was doing 30 down a hill while braking... and no there isnt a sign posted that is why i am asking the question... i think we may of posted at the same time, but i am here temporarily while in grad school so i dont think the license applies to me. I still have residence in texas until i get a place of my own.
so your supposed to take a driving test within 30 days of moving to a new state even if your there temporarily? never heard of that... maybe ill look into that...

It does suck to get nailed for "just driving", tooling along, and not particularly up to anything (as opposed to, say, finding a clear stretch of SD-44 and "making haste" on purpose, unaware that a Turner Co. deputy is running instant-on coming from the other direction. In an old Bronco. D'oh!).
Feeling your pain.
Missouri (not that it matters) is 25mph unless posted otherwise. Yes, it's in the Driver's Handbook. They do have the "Traffic Law" specialist attorneys who can plead a speeding / points-counting ticket to a different charge / no-points ticket [for a price, extra fine, etc.].
Does it help to consider, in a karmic-sorta way, that there have been 1-n times where you *were* "having automotive fun" and weren't ticketed?
Probably not, it never does with me.

hahaha good point! to be honest the only time i really go over the speed limit is on a road trips.. but usually the speed limit is in the 70's or sometimes 80... which is fun haha... whatever thanks for all the info... i think it just bugged me that it made me late for work... and not a good start to my first 30 minutes of my day ahaha

Your frustration is that you didn't know the speed limit where you were driving, like you said - you didn't see a sign, but if it's 25 then you'll pay up. So, you need to go find a sign, don't you? I think if you look again you'll find one that you just didn't see before....
Good luck, but I'm betting you just pay it and go on....
I got a 40 in a 25 a few years ago, our cars accellerate so easily, and I was going home from the vet's with a sick dog, and trying to find the off button for my phone cause it was ringing and I don't answer it while driving. Bottom line, I was distracted - so much so that I almost didn't see the cop waving at me to pull over! $140 distraction, but it could have been far worse if I'd hit something or someone because I wasn't paying enough attention - learned my lesson that's for sure!

oh and my frustration isnt not knowing the speed limit... else i would of said my frustration is not knowing the speed limit... when i dont see a sign iin a residential area i go 30 or lower end of story with that... this never was to be a thread about my frustration... im sorry i had a little rant... just wanted to know if anyone knew where to find the speed limit if not posted in washington state... looked on the DOT website but could not find it... please dont tell me why i am frustrated or why i am not frustrated and what i saw or didnt see... so back on topic....
i will see if i can get a hold of a washington state drivers manual...
once again sorry for my rant earlier and thanks for the good info so far

In Washington, residential street speed limit is 25 mph.

No sign, still 25 residential in my state. Sorry to burst any bubbles but as the father of a little kid I appreciate when people don't tear down my street on their way to work...
As for the folks advocating no speed limits, I'm sure YOU would be responsible but how about the other drivers?

Trust me it's 25, now ask me if people do 25mph on the Street I live on??!! NO!!
I live on a "thoroughfare" of sorts, it starts at a major street, then changes names where it bends and then becomes the street I live on, the Speed Limit on the "thoroughfare" is 35, but goes down to 25mph at one point. The street I live on continues to another "semi-thoroughfare" and ends, the "semi-thoroughfare" is also 25mph...and again people do not drive the Speed Limit.
My Cruise Control is always on when driving in my neighborhood, sadly people think it is a raceway and think it is ok to pass on a Double Yellow Line, on the Right Side over the White Line, or in the Parking Strip.
Long story short, either set Cruise Control or begin braking at the top of the hill and continue braking down the hill.
As you can see I'm also a Washingtonian and I understand your frustration of not knowing what the "Posted" Speed Limit is, I know of many local streets where it is a guessing game, the speed may be post on one side of the street but not the other...so how do you really know??!!

Doubtful - more likely the universe is telling me that Snohomish County Sheriff's are lazy c**ts that just sit around waiting for people to exceed the speed limits on straight roads in the middle of nowhere in the middle of the day. But good won out in the end.
