Seems pretty clear to me that the pro exhaust is not going to pass the new CA laws. But I think it's really going to come down to the discretion of the officer, which is super annoying. Guess I'll keep the valve closed for a while, see how things shake out...

I have the Pro Exhaust on my '19 JCW. The new law in CA was passed in 2018. It came into effect 1/01/19. I find it really hard to believe that my exhaust would be illegal in 2019. "If you heard it on the internet, it must be true".

Its illegal for a registered car to drive with one.
As I mentioned earlier it’s a 1959 law that was turned into a fine
rather than a fixit ticket in 2019.
As as long as the cutout isnt open, it’s not technically illegal.
We don’t have mechanical inspections here.

Nah, I'm not missing any point. Cooper said, "If you have the money to spend you will not get more thrill from your MINI then installing this upgrade". Full stop. Yes, they mentioned the tuning kit is under warranty bu they didn't say it's the most thrill you can get under warranty. And even if they did the Dinan Elite gets you more power and torque while staying under warranty.

Assembly Bill 1824 went into effect in January 2019. This new legislation does not make California vehicle exhaust noise laws more strict. Instead, the Bill only makes it mandatory for police officers to issue immediate tickets to offenders.
AB 1824 enables law enforcement to issue immediate fines for violating exhaust levels. Prior to 2019 police officers issued so-called “fix it” tickets, enabling you to fix your vehicle’s exhaust system within 30 days, provide proof, and avoid paying fines. As of 2019 fines are mandatory, and can range upwards of $1,000.
California Vehicle Code § 27150 – 27153 (2017)Vehicle Code 21750. Adequate muffler required
]27150. (a) Every motor vehicle subject to registration shall at all times be equipped with an adequate muffler in constant operation and properly maintained to prevent any excessive or unusual noise, and no muffler or exhaust system shall be equipped with a cutout, bypass, or similar device.

How many cops do you think have a sound level meter in their patrol car let alone know how to check loudness via SAE J1169?
IT CANT BE DONE!!!
You need to rev your car to 3/4 its max revs (technically 3/4 max HP rating), modern cars can't, due to its neutral rev limiter!!!
Also a STOCK F56S muffler at high idle is LOUDER than 95dB, I know, being a recording engineer, I have my personal meter!!
Thats why most cops in LA don't give a rats ***.

How many cops do you think have a sound level meter in their patrol car let alone know how to check loudness via SAE J1169?
IT CANT BE DONE!!!
You need to rev your car to 3/4 its max revs (technically 3/4 max HP rating), modern cars can't, due to its neutral rev limiter!!!
Also a STOCK F56S muffler at high idle is LOUDER than 95dB, I know, being a recording engineer, I have my personal meter!!
Thats why most cops in LA don't give a rats a**.

It is my understanding that in California one of the issues with oxygen content in exhaust gasses is that smog testing equipment is sensitive if O2 is too high -- and the test equipment won't complete a smog check. So, if somehow a flap or other diverter draws extra air into the exhaust....
Well, apparently cow flatulence is gonna get us before vehicle exhaust does, and, for those of us who lease and never have to do a smog check, I guess the only worry is the noisy neighbor who starts his Camaro up at 5 AM, and blows out a window-shaking rattle from his four tubes. We don't complain -- let him have his fun so we can have ours. But those darned motorcycles roaring down the street setting off car alarms left and right, that's where I draw the line.

JCW's in, kit works great. I dig it. Dealership sold me the tips (which, as it turns out aren't included) at cost. Another member mentioned that his remote thumbswitch didn't come with the foam cup holder thingy - MoP made sure it was in mine. All said and done, its good. I'm glad I got it while its still available.
