Unless I am misunderstanding your message and assuming no damage and that this is the only disk with the problem, I don't think that your caliper is defective. The caliper puck is supposed to retract when the brake pedal is released. It could be hung up by the crud that builds up behind the puck on the walls of the cylinder cavity. Disassemble, clean and reassemble. If you are careful and the rubber is in good shape, no new parts should be required. It is important to bleed out old brake fluid and replace with fresh every few years to keep the system clean.
Is it possible that your emergency brake is adjusted so tightly that it drags the shoes?
