Since 2014, I am running with the "muffler delete" modification.
The sound is very good (perfect loud sound level outside, but no sound inside the cabin ). Then, there is not additional weight to the car.
There is a special chamber instead of the OEM muffler.
You can search mini cooper (justa) muffler delete on youtube and enjoy that magical sound

Yes, there is space for the modification without touching the spare.
The new additional exhaust pipe (functional) will replace the exhaust space volume that was lost when removing the OEM muffler. It will improve the sound too (checked). No need to change anything related to the spare.
You will need too, to install 2 identical tailpipes (for cosmetic reasons)
Additionally, you can roll-back the modification by installing an OEM rear bumper plastic trim (you will need to cut the original) and deleting the second exhaust pipe. You can buy an used original rear bumper plastic trim for $50.

Some people have been custom mod doing this with the Gen 1 R50 / R52 exhaust . Good luck with the project.

I will take some additional pictures before installing the second exhaust.
Believe in me, the new exhaust flare is identical to the OEM exhaust flare (edge, depth, size, etc). It is not impossible!
Do you have any experience/recommendation for the new tail pipes?
I will need replace both to match between it, without loosing the "Mini" style.

More news:
I was searching for new tail pipes for the R56 non-S (ebay, amazon, etc) but I have the opportunity of to buy two used OEM tail pipes from a Mini Cooper S (a guy from here).
Surely the tail pipe diameter should be bigger and the pipe too, but the offer is tempting me and I think the work to adapt it should be easy.
I just need to verify that these tail pipes fits OK into the actual exhaust flares.

I'm looking a place for the spare!
It was removed (and it plastic support).
Additionally the tail pipes are sportier angled oval tail pipes (not Mini Cooper S tail pipes as posted).
Checking sound volume, loud and drone presence on this week to make additional re modification if any.
I will be sharing the complete mod after finished with my ear OK
(sound is louder, louder as a BMW 2.0, on 1.5k-2k RPM and quiet over 3.5k RPM but it needs to be checked deeply to know if really is the expected by me).

Looks great, but you did loose the spare. With the duals it defiantly looks more aggressive . Good job.

Since my location is not U.S., the exhaust shop installed two "TUPER" steel pipes (made in Brazil). It looks good, but I don't want to publish final pics/videos until the sound quality meets what I want (I prefer less sound volume and that means loosing loud sound, I know ... )
Tuper steel tail pipes installed
Today going to my job, I could hear a little vibration and a little drone (I believe) so surely I'll have to strategically install a mini mini mini mini (hehe) resonator.
Anyway today, the car sounds really too good (burble and some pop!) between 0 and 3500 RPM. Drone seems to start from 4000 RPM and over.
I'm thinking in a mini resonator "dented" or to dent the pipe directly. It seems this could cancel some waves and reduce a lot of the resonance.
Maybe something like this, I will be checking that with the exhaust shop tech:
Meanwhile I'm looking for space for the spare and seal the hole that today is in the trunk where the spare was bolted.
Driving without spare is not in my plans.
