How noticable is the wine? My mini does the same only in 5th gear but only from 60mph and up. Its not too noticable only when i turn the radio off. Its not loud at all tho. It started doing this after the dealership replaced my transmission

I'd just go with it for awhile or do the fluid change like he suggested. You may have gotten lucky. You probably didn't blow the clutch, the motor sounds OK, the question is the tranny making a whine when you give it gas with it in gear. I'd just ride it out. If a code was set off for overrevving it's possible that after a number of engine starts it will go bye bye too.

Did you see where the revs ended up? Red line in 2nd is a little over 60 with standard tires, with the normal speedo accuracy, you could probably get to an indicated 65 and not exceed the redline.
Still not a good thing to do though.

Loud enough to hear when the radio is low....but thats just me. The wife prob will not notice but I know it's there. It seems to whine when the rpms are low in 3rd gear and up...when i tap the gas. No whine when the rpms are high...or maybe I just dont hear it.
Ya its only in low rpms with mine too, ive had other people ride in my car too and they also asked me what that was. But iam gunna take it in this week hopefully and solve it... Just hope they dont give me any bad news to leave my car in the shop....

Thank you all so very much for the help. I just drove back home, about 40 miles. Car drives and shifts fine...only thing is the whine. No whine in first or second. I noticed it in 3rd, 4th etc. Seems to occur when I just hit the gas a bit...if I let off, the whine stops...i'm still in gear. I'm in Miami and don't know any one who works on MIni's so i'm SOL. Thnx again for all the info...
is a VERY ACTIVE local group, free to join and post a question about recommendations for a local Independant Shop for your transmission lube change at least. They would most likely agree on just driving it instead of tearing down your transmission.
Consider yourself lucky, in that the usual result of a "Money Shift" would be a completely blown engine, no way for 'Rev-Limiter' to control RPM's for that.
At a certain RPM above Red-Line, your valves will 'float' (not enough time for them to close) and when that happens, they are struck at high speed by the pistons and distruction is pretty total.

The downshift into second should not have caused any large over-reving of the engine or transmission. In second gear I can go about 75 MPH at redline (7200 RPM) in my MCS GP. Thus driving in second at 65-70 should really be OK, however your redline is probably lower than the GPs but your engine/transmission should be able to live through the RPMs in second at 70 MPH.
However, you might have stressed something associated with the clutch or transmission due to the downshift and how the clutch was released (smooth or rapidly). I would suspect a clutch problem more than a transmission problem. However, I would go with Slinger688's idea of changing the transmission fluid because it is easy to do and might help eliminate the noise. On the other hand, the noise could be coming from a damaged part and the different fluid might just mask the noise but not really fix the problem.

nkatsim, don't feel too bad about missing the shift. i've only put a few hundred miles on my Mini, and I find it pretty easy to get lost in the 6-speed. Getting better at it, but I do worry about it. At least I haven't put it in reverse at a stop light recently!
I've driven 5-speed for decades, but that extra gate is killing me!
So took my mini in about 30mins ago, I get there and take one of the techs for a ride to show him the sound in 5th gear and how it stops after 70mph. We get back and he goes back into the building, shortly after he comes out and tells me it is my intake that is making the whistling sound. Nothing new that i havent heard, my fault once again. First they blame me for a failed transmission after one day after purchase, now they say that the sound is from my intake i had put on the car. Complete bs because no one else out of the thousands of minis have the same whistling sound after they put in an aftermarket intake. Going to take it in next week completley stock and show those *********s whos fault it is.....

Ok, so today I'm driving about 65 - 70mph and mistakenly put the gear in 2nd...now, I hear what sounds like a slight whine when I just step on the gas after 4 gear. Everything else sounds normal...engine, no warning lights etc. Anyone have any clue what could be wrong??? Thnx for any help...I've been under a lot of stress lately.

That's nothing. I was topped out in second gear and went back to first! That was a hell of a noise!!!! That was right after I bought my MINI. Everything is still working so I was lucky.
