Well Found my problem! now lets hope i can fix it.
this is the selector for the 5th/6th fork and as you can see it is broken i found the broken part on the magnet. now all that's left to do is find a replacement or have a machine shop weld on material and cut it down. or have them make me a brand new part.
as i was playing with it to watch what was going on with the cover off the finger would go into the slot but when you went to turn the relay shaft it would just slide right out of the slot, so that's why i could not select 6th and why 5th would be troublesome some times.

Good news! i found a great deal and im getting a re-manufactured gearbox off someone cool for, $500 never used still in its box. its got 52k on it. It will be here, i really really hope, by tomorrow so i can install it either tomorrow night or friday morning. Im still going to try and fix my old box and ill put it on the side just in case. i need it down the road.
So today was a long day but got a lot done. ill put some pics up when i get a chance. i know yuo guys love pics..... so do I
installed new
- rear main seal
- clutch/ pressure plate
- Lower control arm bushings
- Steering rack bushing
- Gear box mount inserts
- lower enigne mount inserts
so whats left is
- oem belt
- upper engine mount inserts
- install gear box
- plug everything back in and hope it works.

little update..... so everything looks to be in good working order rplaced things that needed to be replaced. the trans is in, sub frame is in driver side axle and everything is hooked up where its supposed to be last thing left is to put in passengers side axle and engine mount.
and becasue murphy seems to be revolveing around me this whole time my dip stick broke so i ordered a craven speeed one should be here tomorrow, and got a ultra gauge. oh and i messed up my passenger side cv berraing going to see if i can fix it or get a new one. dont know if i lost all the rollers inside the bearing. oh and brake lines need to be done too.

i read on the web site you can make the refreh much faster, im gonna look at the maual tonight and see but so far i like it

yea so all you have to do is go into the gauge page menu and go to refresh and change the rate to 0.3 sec. i think that's plenty fast and shows everything i want perfectly.
SOooooo...... The Mini is back up and running and it is glorious! i did not install my SS brake lines or the upper engine mounts because i just wanted to get back into my car all ready. so ill leave those for a later date again.

I also have the ABS and Traction Control light on and the TPMS light. any ideas what could eb the problem? code reader doesn't say a thing. i might have to go to MINI and see what there computers can tell me.

Fantastic! the car is so smooth and tracks very well, steering is very posative and it feels like you actual know where the wheels are going.
cant wait to put the upper engine mounts in! at the moment at idle its very minimal vibration. but when you blip the gas from idle to about 1000-1100 rpms its a little harsh but under regular drive no vibrations at all. power gets to the wheels nicely.

Well my problem with my ABS DCS and TPMS light went away by its self. so maybe it was the stuck brake caliper i had. anyone know if it takes a certain amount of miles before the problems correct them selves? ABS definantly works i slamed on the brakes to make sure. and i tired a hard start and the DCS is as invasive as it was before no wheel spin and engine pwoer was cut hahaha. and TPMS light went out too.
and this all happend after i went to the dealer to make an apointmant; why i need an apointment for them to plug a computer into my car and tell me whats wrong is beyond me but what ever. myabe its just a coincidence that everything is fixed now that i made an apointment, or it was the $130 price tag to "diagnose" the car that scared my mini straight. :D

anyone know if it takes a certain amount of miles before the problems correct them selves?

It can take a couple or a lot of drive cycles to clear the code from memory once a problem is properly fixed. One drive cycle is considered when the car starts and when the car is cold until it reaches operating temperature. I have seen them go off in a few miles to 40-50 miles before they have cleared themselves. This is just my opinion.
ok cool, dont think its the yaw sensor but if it is pics would be great!

so i cleaned all the WSS's the front ones where covered in crud. the rears where perfectly clean. the lights did not go out, so went for a long drive. stopped got out went for a walk. came back started it up and lights are out and everything works. i drove a few miles and did the same thing again and lights still stayed out. so hopefully it was just dirty sensors and not a bad WSS or i hope its not the ABS module. but time will tell.....
